30-Mile Oil Spill Appears in Gulf

On Monday afternoon, oil mousse and tar balls from what is reported to be a 30-mile oil spill were washing up on beaches spanning territory from Grand Isle to West Timbalier Island.

According to reports, scientists are actively conducting tests to determine whether or not the oil is coming from the damaged Deepwater Horizon rig which exploded almost one year ago.

Other possible sources for the oil spill are being considered, including a project to plug and abandon a well near Grand Isle.

Gulf Coast AGs Urge BP Claimants to Consult Attorneys Before Accepting Payments

Attorneys General in Florida, Alabama, Mississippi, and Louisiana issued statements over the weekend urging BP Claimants to consult with attorneys before accepting payments from the oil company and its representatives.

These statements surfaced in the wake of an announcement by BP Claim Czar, Kenneth Feinberg, which indicated that claimants would now be able to accept payments in 3 forms: Interim, Final, and Quick Payments. According to this new system, claimants could accept Quick or Final Payments in order to speed up the payment process but would receive less money in the long run and would also be required to sign away their rights to sue BP in the future.

Accepting Final or Quick Payments would now mean that even if claimants suffer future damage from the Oil Spill which they are either currently unaware of or has yet to display its effects, they would be prohibited from suing BP for damages.

La. Oyster Committee Meeting Today

The Governor’s Oyster Advisory Committee is scheduled to meet today to discuss the future of the Louisiana Oyster Industry as well as anticipated uses for the Reimbursement Funds awarded by BP to the state.

The Committee will be meeting from 1-3 pm at the University of New Orleans campus.

First Oil Spill Trials May Be Slated for Next Summer

U.S. District Court Judge, Carl Barbier, who is tasked with presiding over the more than 300 lawsuits filed by individuals and companies against BP as a result of the Deepwater Horizon Oil Spill has indicated that he would like to set the first trial for June 2011.

BP’s lawyers have expressed discontent over the intended date indicating that they would prefer more time to prepare their cases. Judge Barbier, however, has expressed desires to expedite the process.

Drilling Moratorium Lift to Occur Soon

The White House announced that the moratorium prohibiting drilling for oil in the Gulf of Mexico that has been in place since May will soon be lifted. The drilling companies must follow the new standards and guidelines in place since the explosion of the Deep Water Horizon rig in order to be allowed to drill. The original date of this lift was scheduled for November 30th, but due to an unexpected efficiency with regard to the moratorium, White House Press Secretary Robert Gibbs believes that the lift could occur within the week.

Those who originally opposed the moratorium, especially Louisianians economically dependent upon the Gulf, are relieved to hear that they will soon be closer to back to normal following the explosion of the rig half a year ago. Three rigs that were in use during the time of the explosion have already left the Gulf, and another four are scheduled to depart. This news about the potential early lift of the moratorium could possibly change the plans for many of these operations.

Justice Department Urges Feinberg to Speed Up BP Claims Payments

Since taking over supervision of the BP Emergency Oil Spill Claims Program about a month ago, Kenneth Feinberg has met with substantial criticism over the pace at which claims are being paid out.

Feinberg originally came into the position making statements which indicated an extremely optimistic prediction of his ability to organize the claims process so that it would be able to make payments in a matter of days to those with legitimate claims. Such statements have since been admitted to have been inaccurate by Feinberg and his staff.

While Feinberg’s organization has managed to pay more than 35,000 claims at a value of almost $400 million, a figure which surpasses the amount of payments made by BP during an almost 4-month period, there are still more than 40,000 claimants yet to receive any form of payment.

It is because of the large amount of claimants who are still waiting to be paid that Associate Attorney General, Thomas J. Perelli, sent a letter to Feinberg last week calling the current state of procedures “unacceptable”.

This news reminds us that many people who have been seriously affected by the oil spill have still yet to receive any form of compensation to help make their lives whole again.

Grand Isle ‘Oil Hotspots’ Indicate Fallout From Spill Is Far From Over

A recent report by NOLA.com about the residual effects of the oil spill in coastal areas such as Grand Isle and Fourchon has indicated that the widely held view that Louisiana dodged a bullet in the aftermath of the BP Oil Spill could be mistaken. Oil Hotspot in Grand Isle

According to the report, large patches of oil are being discovered a few inches below the surface of the sand on many beaches. Large ‘patties’ of stratified oil are also being identified in the water which leech oil residue into the marshes and Gulf as tides recede.

While these areas are concentrated in ‘hotspots’ (about 500 miles of coast) that seem relatively minor when compared to the 7,700 total miles of Louisiana coast that largely avoided oiling, the concentrations of oil in these area still represent mortal threats to wildlife and potential hazards to humans residing in the area.

Recent Report Says BP Blames Itself and Others for Oil Spill

In a recent 193-page report released on September 8th, BP blamed itself for much of the explosion and spill of the Deepwater Horizon Rig in the Gulf of Mexico.

They also blamed other companies’ workers at Transocean Ltd. and cement contractor Halliburton. On Saturday, the blowout preventer that failed to stop the oil from leaking from the well off the Louisiana coast was raised from the water and the government is conducting investigations into its failure. Rig workers knew of problems shortly before the explosion but allegedly expressed little concern. Some of BP’s engineers have been accused of cutting corners to save money and time when the blast occurred.

Also found in the report was that the oil spill accident could have been minimized if the crew had directed certain fluids overboard. Halliburton also suggested that BP add certain components to its operation days before the spill but BP rejected this recommendation and the rig exploded five days later.

St. Bernard Parish Claims BP Slow to Pay Companies Involved in Oil Spill Cleanup

According to recent reports, owners of land upon which crews involved in the oil spill cleanup effort in St. Bernard Parish are working have issued notices to vacate the premises due to non-payment. Photo Courtesy of Nola.com

St. Bernard Parish president Craig Taffaro, has issued statements indicating that Amigo Enterprises, one of the landholders that has issued a notice to vacate is owed more than $3 million by the contractors staging out of its property. The contracting firms claim that slow response on the part of BP have made it impossible for them to pay the amount owed.

Additionally, St. Bernard Parish owes more than $34 million to Loupe Construction, a firm that has contracted to provide an array of equipment used in the cleanup effort, and is also claiming delays from BP as the reason for non-payment.

BP has issued statements in its defense that claim that St. Bernard Parish officials and contracting agencies have failed on a number of occasions to provide the proper documentation in order to justify reimbursement.

Gov. Jindal Calls for BP to Fund $173 Million Seafood Monitoring Program

As news surfaced today that scientists have discovered a 22-mile-long plume of underwater oil extending to the southwest of the BP oil well that exploded months ago, we are reminded that the long-term effects of the spill have yet to be fully determined.

In an effort to maintain safety and stability in the affected region, Louisiana Governor Bobby Jindal is supporting a proposal that would call for BP to invest $173 million in a fund that would support monitoring the safety and quality of the state’s seafood for the next 5 years.

BP has currently agreed to a plan that would provide $13 million dollars for a 3-year monitoring program with the possibility of extension but has yet to respond to Governor Jindal’s request.

Louisiana produces roughly one third of the United States’ domestic seafood – an industry which contributes about $2 billion every year to the state’s economy. Part of Governor Jindal’s proposal involves BP footing the bill for large scale marketing campaigns designed to alleviate national concerns over the safety of the region’s seafood.
