NOLA’s Birdman Busted: When Can the Cops Search Your Car?

birdman-fastmoney.jpgNOLA native Birdman, aka Bryan Williams, was busted yesterday in Tennessee — along with 16 other people in his RV as it rode along Interstate 81 — for possession of marijuana. 

According to press reports, a police officer saw the RV change lanes, forcing a tractor trailer rig into the emergency lane.  The cop pulled the Birdman-mobile over, and smelled marijuana smoke coming from inside the RV.  He asked for permission to search the RV, was given consent, and found a pound of marijuana in a trash can, in the RV’s kitchenette.

He also found a handgun, a magazine for a .45, and an assault rifle.  (This has brought ATF into the case, but there haven’t been any charges on the guns yet.)

janadamsdco.jpgToday’s news is filled with the scoop that Dr. Jan Adams, the plastic surgeon that operated on Kanye West’s mom right before she died, walked off the live set of Larry King Live last night.  TMZ has the video, if you want to see the replay.

And, right along with that reporting is the story that Dennis Quaid’s infant twins were inadvertently overdosed while at Cedars Sinai and while the situation was scarey, it looks like they’re going to make it.

Okay.  What should these families be doing, to protect their interests in they want to file a medical malpractice suit later?  What should you do, if you’re in a similar situation?

The Death of Kanye West’s Mother – Medical Malpractice

west.jpgOver the past few days, not only has the untimely death of Kanye West’s mother been reported, but TMZ.COM has gone to great lengths to investigate the criminal and civil history of her plastic surgeon, Dr. Adams (BloomLegal has compiled this into a shockingly long list, shown below). 

Condolences to the West Family, and good luck to them in their medical malpractice claim against Dr. West — which you know is coming.  And to think this guy appeared as a plastic surgery expert on Discovery Channel and on Oprah (check out his website).

Nick Hogan Arrested on Felony Charges in Speed Racing Accident

nick-hulk-hogan.jpgIt was Nick Hogan’s yellow hatchback Toyota Supra against Daniel Jacob’s silver convertible Dodge Viper.  Speed racing was involved in the August pile-up that incapacitated John Graziano ….

As detailed in today’s News Release by the Clearwater Florida Police, Hulk Hogan’s son, Nick Hogan Bollea, turned himself in this morning and was booked on the both felony and misdemeanor charges resulting from the August 26th car crash that left his friend John Graziano seriously incapacitated.   Witnesses have confirmed that Nick Hogan was speed racing with Daniel Jacobs, who’s being charges with reckless driving.  

What’s the law here?  Well, both civil and criminal law come into play in serious car crashes like this one.   There’s jail time to consider, fines, and big civil damages.  Continue Reading »

Shia LaBeouf Busted 4 Criminal Trespass in a Walgreen’s – the Legalities

shialabeouf.jpgYesterday, according to the Associated Press, Transformers star Shia LaBeouf was in a Chicago Walgreen’s store, and a security guard told LaBeouf that he needed to leave because LeBeouf looked like he was drunk.  It was around 2:30 in the morning.

Shia LaBeouf refused, so the guard held him and called police.  The Chicago police arrested LaBeouf for criminal trespass. LaBeouf posted bond and was back out on the streets by 7.  Interestingly, he was not booked on any charges related to being intoxicated ….

What’s criminal trespass?  And what’s with this guard detaining someone?  Was that illegal?
