Halloween Safety Tips

candycorn.jpg1.  Driving drunk can mean just leaving happy hour or a party with a slight buzz. You may not feel drunk and still, your blood alcohol content may be over the legal limit. Driving with a buzz can mean a DUI.  For someone the size of pre-pregnant Nicole Ritchie, that could mean as little as half a glass of wine.  

2. Remember that “tricks” cannot be “vandalism.” Throwing eggs at a car, or toilet paper into trees, can be seen as misdemeanors by the authorities. Don’t do anything that may cause damage or expense to anyone.

3. Search your kids’ candy before anyone eats anything. If anything doesn’t look pristine and perfect, toss it. Tell the kids they can make up for it with a bag of clearance-sale candy at the grocery later.

4. If you find something in the treat bag that’s definitely been tampered with, put it in a Ziploc and call the police immediately. See if the kids can remember they got the tampered candy — street names are good, apartment numbers or house descriptions are better.

David Copperfield’s Abra Cadabra — The Magic of Jurisdiction!

davidcopperfield2.jpgA model based out of Seattle, Washington, is claiming that magician David Copperfield flew her to his private $50-million island estate in the Bahamas, and at some point during this magical getaway, she was raped.

Upon returning to Washington State, she reported this incident to local and state authorities, who refused the case because of geography (a lack of jurisdiction). Now, apparently, a federal grand jury is investigating criminal charges against David Copperfield based upon a FBI argument that there is federal jurisdiction.

But is David Copperfield immune from any American charges?  Maybe.

The FBI’s argument is purportedly based upon the model leaving the USA at Mr. Copperfield’s invitation, and then returning to the USA thereafter. However, if any alleged wrongdoing did not occur on American soil, then what may or may not have occurred on Copperfield Island may be a “crime” only if the law of the land declares it to be so.  Gambling isn’t illegal in Monaco or Vegas, for example, because the law says otherwise.

What law applies to Mr. Copperfield’s island estate? Bahamian law.

The law of the Bahamas defines what “sexual assault” or “rape” is within its borders, and what evidence is needed to prove that it occurred.  Maybe it’s the same as in the United States, maybe it’s not. Has any complaint been filed with this authority? No.

According to the alleged victim, she did not make a report to the local authorities, nor did she have a rape kit test taken there.

Not only is there a choice of law question here, but there’s a real proof issue: evidence should be collected within 72 hours of an attack, or a sexual assault examination (“rape kit”) is of little value: the evidence is gone.

Why are we still not hearing about this woman pressing charges with the Bahamian authorities? �

California Fires — Malibu to San Diego: 5 Things U & the Celebrities Can Do When Your Home is Threatened

fire_01.jpgThe California fires continue to rage this morning, covering an area north of Malibu southward to San Diego.  Right now, there are 11 major wildfires that have already decimated over 30,000 acres of land.  And more wildfires are expected: burning embers will be carried by the Santa Ana winds throughout more of dry Southern Californian land today. 

It’s rumored that the fires began after high winds blew down some power lines, which landed in dry brush with their small electrical sparks starting all this.  The San Diego fires have already claimed one life this morning.  A map of the California fires can be found at the National Weather Service California Fire Site.

Orlando Bloom, Lindsay Lohan, Britney Spears: Hit & Runs

lohan_arrest2_070724_ms.jpgOrlando Bloom is reportedly being investigated by Los Angeles authorities for a hit and run last Friday night. Driving a friend’s car, Orlando had a car crash that left his friend (riding in the front passenger seat) with a fractured neck. Paparazzi recorded Orlando walking away from the scene, and then walking back, and later asking someone to call 911.

Lindsay Lohan’s out of rehab, but she still has to face hit and run charges stemming from her collision with a tree last Memorial Day. Lindsay was also charged with DUI – and cocaine was allegedly discovered in the car, as well. Lindsay was filmed running from the scene by paparazzi ….

Britney Spears was charged with hit and run on Monday, after she bumped her convertible Mercedes into another vehicle while she was parking the car. Paparazzi caught the entire episode — including Britney checking her car for damage, but not the victim’s, before going on her merry way — on video.

Kiefer’s DUI and Britney’s Hit and Run – Big Deals?

car_crash_2.jpgThis afternoon, Kiefer Sutherland’s attorney announced that he pleads “no contest” to Driving Under the Influence (he was arrested on 9/25 for two misdemeanor counts of DUI)  — he pled the same thing to a prior DUI in 2004. 

Also this afternoon, Britney Spear’s attorney appeared in court on her behalf — and Britney has been ordered to come into LA County and be booked for hit and run before the big 10/26 hearing in her custody case.

Britney Spears – Synopsis of the Court Orders and the Other Legal Stuff: One Lawyer’s Take on the Whole Mess

britneymtv.jpgFirst, the kids:  the next hearing in the Britney Spears – Kevin Federline custody fight is scheduled for 10/26/07 before Commissioner Gordon (am I the only one that thinks “Batman” every time this guy’s name pops up?) …. Here’s a round-up:

10.04.07 – Britney Misses First Court-Ordered Visitation With the 2 Boys

 Britney’s kids wait in the car, stuck at the security gate, for 45 minutes and then return to Kevin Federline.  Britney Spears’ alleged reasons for not seeing her kids:  she was asleep and didn’t hear the buzzer, the intercom was broken, and today, Britney didn’t want to have the parenting coach around so she just didn’t answer the door.  Britney also tried to have the first visit in an hotel room, but Kevin Federline’s attorney nixed that (assumedly he threatened a court hearing on the issue) and Britney checked out of the hotel and returned home for the visit. 

10.03.07  Visitation Order Requires Supervision Of Britney During Visits

Another hearing – another Order:  this one placing even more restrictions on Britney Spears, in part because the Judge noted she had not been in “substantial compliance” with his prior orders and also in response to Britney not showing up for drug testing.  Now, not showing up for a test will be  “deemed by the court as a failed test.”

Howard K. Stern Sues Over the Cosby Book – Where’s Larry Birkhead? What about DannieLynn?

Stern filed a $60 million suit against (1) Rita Cosby and (2) Hachette Book Group USA, Inc. today in an Atlanta federal court.  He’s asking for $10 million in actual damages and another $50 in punitive (or punishment) damages from the author and publisher of Blonde Ambition

Larry Burkhead isn’t a party to this suit; however, his lawyer is claiming that Larry will be filing suit against Cosby and her publisher, too. 

In his lawsuit, Howard K. Stern claims he has been harmed by the book, and that Anna Nicole Smith has been harmed, too, because the “[d]efendants have exploited Ms. Smith’s life and death by publishing false and defamatory factual accusations” against Stern.  Which implies that Dannielynn has been harmed, as well, even though she’s not a party nor is Anna Nicole’s estate at this point.

How is Dannielynn harmed?  Think of Lisa Marie and Elvis — Elvis’ legendary persona benefits Lisa Marie in many ways; if nasty things were imputed to Elvis now, Lisa Marie would be hurt financially and otherwise.  Same for Dannielynn — she stands to benefit from the continuing popularity of Anna Nicole and to the extent that Anna Nicole’s persona is harmed, DannieLynn is harmed as well.

Of course, how AnnaNicole’s reputation could be tarnished and harmed at this point — well, there’s a fact question for the jury if there ever was one ….
