NOPD Receives Scathing Review from Justice Department

March 21st, 2011 | Posted in Local Issues, NOPD by bloom | No Comments »

When Mayor Mitch Landrieu and Police Chief Ronal Serpas took office, they welcomed outside review of their purviews, but they may have underestimated the incompetence that would be unearthed. Even more so than the review of City Hall earlier this year, the Justice Department’s assessment of the NOPD has revealed alarming inadequacies and outright corruption.

It was found that officers were habitually using excessive force, as witnessed by the Krewe of Eris, and investigations into these incidents were not thorough enough to determine innocence. Many investigations of officer-involved shootings were so mishandled that the report considers them, “a deliberate attempt to make it more difficult to criminally prosecute any officer in these cases.”

The report also found that the NOPD was arresting a disproportionate amount of African-Americans through the practice of racial profiling. The Times Picayune reports that, “in other cities that collect data, the ratio of black-to-white juvenile arrests is 3:1 after adjusting for population,…the rate in New Orleans is 16:1.”

These are just some of the most egregious in a long list of problems including K9 units that attack their own handlers. Hopefully over time, the NOPD will see effective reform, but the problems persist. If you or anyone you know has been mistreated by the NOPD, Bloom Legal can fight for you. This year as usual, New Orleans will be swept up in a sea of green block parties and parades from Metairie to the Irish Channel starting Friday March 11 with Jim Monaghan’s Annual Irish Parade at 6:30pm in the Quarter.

While St. Patrick’s Day in New Orleans can be a blast, it is important to remember that we are coming out of a week that saw 825 alcohol citations across the city and countless other arrests. It is very important to exercise responsible drinking during and after parades in the city.

DA’s Office Pushing for Reform in New Orleans Courts

The Times-Picayune reported today that District Attorney Leon Cannizzaro’s office has been working recently to improve procedures at New Orleans Criminal District Court.

Among other things, Mr. Cannizzaro has urged the 12 judges at the CDC to more than double the number of jury trials they intend to hear this year (up to 600). Mr. Cannizzaro’s office and the public defender’s office both agree that the new goals and procedures will improve the court’s operations.

Furthermore, Mr. Cannizzaro’s office is now taking issue with certain rulings issued by Criminal Court Judge Benedict Willard. According to the Times-Picayune, Judge Willard has either delayed cases (prompting intervention by the state Supreme Court) or repeatedly issued rulings which have had to be overturned by an appellate court.

This apparent new activism on the part of the DA’s office represents a level of public dissatisfaction with the local court system which has not been voiced in a number of years.

Slidell Proposes Allowing Drive-Through Alcohol Sales

February 9th, 2011 | Posted in DUI/DWI, Local Issues by bloom | 1 Comment »

In 1966 the Slidell City Council banned the use of, “drive-up windows and/or drive-through buildings… for any commercial establishment selling and/or dealing in alcoholic beverages.” But now after nearly 45 years, the city known for its conservative alcohol policies will consider repealing the ordinance.

Two local Slidell businessmen approached public officials to discuss the aging policy. One owns a daiquiri shop and the other a convenience store which plans to sell other goods in addition to alcohol through the drive-through. Talks have gone well, and the businessmen have gathered considerable momentum for their idea, including support from the mayor.

New Orleans and many other nearby parishes already allow the sale of alcohol from drive-through windows. A drive-through convenience store is located on Veterans and Bonnabel in Jefferson Parish, and daiquiri shops are spread throughout the city.

If the old ordinance is lifted, drivers must still abide by Louisiana’s open container law which prohibits any open alcoholic beverage from being kept in the passenger area of a car. A daiquiri is considered “closed” until a straw is inserted into the cup or the lid is removed. If you or anyone you know has been charged with violating the state’s open container law, immediate legal defense is needed to preserve your rights and to maintain the ability to effectively fight your charges.
