Mattel Toys – 3 Recalls in 36 Days: What’s all this Danger of Lead Paint?

elmorecall.jpgMattel Toys is issuing its third product recall since August 1st, many due to toys manufactured in China where lead paint was used.  In the US, any toy with 0.06% lead paint must be recalled.  That’s not much.

The Associated Press reports that 80% of the world’s toys are made in China, so expect more recalls to follow Mattel’s lead (pardon the pun).

Larry Birkhead & Howard K. Stern: R the Rumors True? Will Larry Sue?

blondeambition3.jpgLarry Birkhead is mad as a hornet, telling TMZ.COM that he’s going to sue author (and former MSNBC correspondent) Rita Cosby as well as ”other individuals … over confidential information in my custody case” if the rumors (click here to read them) about what’s in Cosby’s new book, Blonde Ambition: The Untold Story of Anna Nicole Smith’s Death, are true.    

Larry Birkhead’s also threatened anyone who prints excerpts or other information from the book with a lawsuit too — including OK! Magazine, who is scheduled to spotlight the book in its next issue.  

Of course, on the same day, OK! Magazine cancelled its $1.7 million deal with Larry Burkhead for an exclusive photo shoot of DannieLynn’s first birthday.  E!News quotes OK!’s editor’s explanation that the cancellation was due to OK!’s discovery of “explosive” and “shocking” allegations that “would not allow” OK! to promote what it’s calling “this family’s highly questionable relationship.”  Larry says OK! is just mad because he’s made another million-dollar deal with US Magazine for a cover story on DannieLynn. 

Larry Birkhead tells TMZ that it was author Rita Cosby who referred him to attorney Debra Opri, and it’s reasonable to assume that his reference to “others” with confidential information about the custody fight includes his former lawyer.

Owen Wilson’s Attempted Suicide: Courtney Love Risks Slander Suit With Steve Coogan

owen-wilson_030.jpgOwen Wilson attempted suicide on Sunday; his camp isn’t denying it, and the confirming 911 police log is already floating through the media.  Lots of folk love Owen Wilson — including Courtney Love, who has gone public with US Weekly, telling the magazine that it’s all Steve Coogan’s fault.  [Interesting sidenote: this morning, Wilson announced he was dropping out of Ben Stiller's Tropic Thunder, where he and Coogan both had supporting roles.]

The New York Post is reporting that Courtney Love blames British actor Steve Coogan for supplying Owen Wilson with drugs – specifically heroin and cocaine – and fueling a severe addiction.  Fox News is quoting Courtney Love.  Steve Coogan is fighting back in the media, making denials and warning that he’s talking with his lawyers.

Blockbuster Videos & The Alternative Lawsuit: Digg It?

bridefrankenstein.jpgOn Friday, disgruntled Blockbuster customer enyaWeCurB posted a story of dissatisfaction with Blockbuster Videos, complete with giving the phone number of BB’s local Sherman Oaks branch store, for those who wish to let them know they shared enyaWecurB’s pain.   By Monday morning, the post had 1692 Diggs over at Digg.Com and was heralded as one of the Top 10 Posts for Entertainment by mid-morning.  Bet that the Sherman Oaks store doesn’t share this enthusiasm….

Ving Rhames’ Pet Dogs – What Happens Now?

mastiff.jpgThe latest news reports are that Ving Rhames’ dogs are not responsible for the death of their caretaker, although more than one dog did bite the man, more than once.   The autopsy is scheduled for Monday morning; the four dogs that were found loose on the property (three Mastiffs and one Bulldog) have been taken, and are being held, by the authorities.

britney_spears.jpgTMZ.COM is reporting a story from Life & Style that Britney Spears is telling her two sons things about Grandma Spears like, “She’s a bad lady,” according to an unnamed “insider.”  Brit doesn’t want her mom around her boys.  Britney’s mom, Lynne Spears, does have legal rights, though – and TMZ.COM covered those, as well:  under California law, grandparents do have legally protected visitation rights.

Chris Benoit, Anna Nicole: Are Their Doctors Responsible? Should U Trust Your Doc?

chris-benoit_169×171.jpgChris Benoit’s doctor and Anna Nicole’s psychiatrist both claim to have been close friends with their deceased celebrity patients.  Criminal investigations are now underway to determine if these ”good pals” were also to blame for their deaths.  

If the doctors’ actions did contribute to the deaths, then expect to have civil suits filed, as well.  Dannielynn’s guardian (i.e., Larry Burkhead) can sue for wrongful death based upon medical malpractice.  There’s a twist in the Benoit case:  state wrongful death statutes list who can sue for the wrongful death of another, and usually it’s limited to immediate family.   Georgia law will decide if any Benoit relatives can legally seek civil remedies.

I predict civil suits will be filed.  Why?

Last week, Chris Benoit’s doctor was indicted by a federal grand jury for illegal distribution of prescription drugs - including Xanex(alprazolam), Percocet (oxicodone), Adderal (amphetamine), and Lorcet(hydrocodone).  It’s a seven-count criminal indictment, involving seven prescriptions written to two patients.  It doesn’t include his patient, 2004 WWE champion Chris “The Canadian Crippler” Benoit. When Chris Benoit’s toxicology reports get in, new charges may well be added.  

Meanwhile, California authorities are investigating two of Anna Nicole Smith’s doctors.  The California Department of Justice is reportedly investigating her psychiatrist, specifically, for prescribing methadone to an 8-month pregnant Anna Nicole, as well as prescribing (click to see the dr’s fax) Dilaudid, Lorazepam, Soma, Delmane, Methadone, and Prexige shortly after Daniel’s death.

Paris Hilton and Scooter Libby: What’s With this Pardon Business?

paris-hilton-celibate.jpgTMZ.COM has pointed out that Paris Hilton had to serve jail time, while Scooter Libby didn’t … and their post includes surveys showing that the American public believes both should have done their time.  Over at Kavips, the comparison between Paris Hilton and Mr. Libby is also being made, with its big question being “if Libby got pardoned, why didn’t Paris?”  FreeRepublic is throwing Li’l Kim into the mix: what about her jailtime (10 months, a $50,000 fine, and probation till 2009)? 

Bill Totten points out that there’s a lot of humor to be found in the fact that Paris Hilton has done more time than Scooter Libby.   For the more serious sorts, The Foxhole has one perspective, JoSwift has the other.
