July 6th, 2011 | Posted in National Issues by bloom | 1 Comment »

Orlando jurors yesterday, found Casey Anthony not guilty in the murder of her 2 year old daughter Caylee.

This verdict has sparked considerable hoopla among talking heads and the general public via avenues such as social media who evidently believed that Casey was guilty of the murder of her child. This case brings to light some interesting legal dilemmas such as the influence of public perception and media portrayal in the unfolding of a case of this scale.

While many are apparently outraged at the perceived exculpation of a murderer, still others are taking the verdict as a clear victory for defendants’ rights. It is important to remember that in the American justice system, defendants are presumed innocent until proven guilty beyond a reasonable doubt. It is of equal importance to note that a jury of 12 individuals who heard approximately 2 months worth of testimony, arguments, and evidence were, despite intense media coverage to the contrary, evidently unconvinced beyond a reasonable doubt of the guilt of Casey Anthony in this matter.

It has been somewhat distressing to observe the amount of vitriol and outrage expressed by a large portion of the American public and particularly influential members of the media with respect to a matter and information to which few outside of the involved legal parties are actually privy.

It is not our place to speculate as to the guilt of Casey Anthony in this matter but we would like to remind our readers that the fundamental rights to a fair trial and the placement of the burden of proof upon the prosecution are aspects of the American judicial system which exist to protect us all from frivolous accusation, wrongful conviction, and slanderous speculation.

Lakers Backup Arrested for Battery in New Orleans

April 25th, 2011 | Posted in Celebrity Justice, Local Issues, NOPD by bloom | No Comments »

Derrick Caracter, a backup forward for the Los Angeles Lakers (who were beaten by the New Orleans Hornets in the NBA Playoffs last night), was arrested early Sunday morning for allegedly hitting a pregnant waitress at the Canal St IHOP downtown.

Caracter apparently became involved in an altercation with the waitress after attempting to grab and pull her. This prompted the IHOP’s manager to flag down a nearby female NOPD officer who eventually intervened, arresting Caracter on charges of public intoxication, resisting arrest, and battery.

The Laker has been released from jail but the circumstances surrounding his bond are unknown at this time.

For more on this story as it develops, visit NOLA.com

Based upon a press release from today, NOPD’s version of the story is as follows:

(April 25, 2011) – Eighth District officers arrested Los Angeles Lakers’, Derrick Caracter, 22, after he grabbed and shoved a pregnant cashier at the IHOP Restaurant in the 800 block of Canal Street.

Caracter was refused service at the restaurant around 1:00 A.M. Sunday morning, because he was obviously drunk, unruly and started harassing the pregnant cashier. One officer was called to the restaurant, and attempted to diffuse the situation. But Caracter was uncooperative, so that officer called in back-up. Caracter continued to be belligerent with police and was subsequently arrested.

Caracter was booked with Simple Battery on the pregnant woman, Public Drunkenness and Resisting Arrest.

The Public Affairs Office is trying to obtain a copy of video surveillance recorded by an IHOP camera.

State Rep From Metairie to File Anti-Abortion Legislation

April 20th, 2011 | Posted in Courts, Local Issues, National Issues by bloom | No Comments »

John LaBruzzo, a Republican state legislator from Metairie (who last made headlines in ’08 when he announced that he was studying a plan to pay poor women $1000 to get their tubes tied), has filed a bill which would ban all abortions in the state of Louisiana and also subject any doctors performing abortions to criminal charges.

According to reports, LaBruzzo’s original draft includes criminal charges against women receiving abortions but the lawmaker elected to amend them out for fear that their inclusion would make the bill too difficult to pass. (Although it would appear that if this were not the case, then the provisions would have remained).

LaBruzzo has indicated that he decided to file House Bill 587 after being approached by an unnamed conservative religious organization. It would appear that the intent is to head directly into lawsuits designed to take a case to the Supreme Court.

It is unclear at this point what has inspired LaBruzzo to deem himself a worthy challenger of the Roe v. Wade Supreme Court decision which has stood since 1973 and effectively legalizes abortion in the United States although it is easy to speculate that this is a bid for publicity and the currying of favor from politically-connected conservative religious organizations.

Actor Nicolas Cage was arrested on Friday night in the French Quarter. According to sources, Mr. Cage was seen having an argument with his wife outside of a French Quarter residence and at some point became agitated and began punching cars before attempting to get into a cab.

Police officers who had been flagged down by onlookers removed Mr. Cage from the cab and arrested him. He has been charged with domestic abuse battery, disturbing the peace, and public drunkenness.

In a strange development, Mr. Cage’s $11,000 bond was posted by Dog The Bounty Hunter who has averred that he is a big fan of the actor’s.

It is unclear at this point what the exact circumstances leading up to Mr. Cage’s arrest were or how his legal situation will turn out.

Father Daughter Team Steal 7 Used Cars

April 6th, 2011 | Posted in Local Issues by bloom | No Comments »

The pair would contact local dealers and private sellers about purchasing a vehicle and secure a test drive. As the pair drove away in the car, the dealer was left to figure out they were never coming back.

Joseph and Jessica Billiot had been exploiting local used car dealerships and private owners throughout the final months of 2010 before being arrested on Monday. The pair would sell the stolen cars to salvage companies on the West Bank under their real identities, which led the police to put out a warrant for Joseph’s arrest.

It was the father’s attempt to steal $600 worth of power tools from a residence on Clearview Parkway that led to his arrest. Joseph was also identified as the man on a residential surveillance camera stealing power tools on a seperate occasion.

The two would use the money to support Jessica’s heroin addiction. If you or anyone you know has been arrested for theft, contact Bloom Legal at 504-599-9997, for a free, no-obligation consultation.

NOPD Receives Scathing Review from Justice Department

March 21st, 2011 | Posted in Local Issues, NOPD by bloom | No Comments »

When Mayor Mitch Landrieu and Police Chief Ronal Serpas took office, they welcomed outside review of their purviews, but they may have underestimated the incompetence that would be unearthed. Even more so than the review of City Hall earlier this year, the Justice Department’s assessment of the NOPD has revealed alarming inadequacies and outright corruption.

It was found that officers were habitually using excessive force, as witnessed by the Krewe of Eris, and investigations into these incidents were not thorough enough to determine innocence. Many investigations of officer-involved shootings were so mishandled that the report considers them, “a deliberate attempt to make it more difficult to criminally prosecute any officer in these cases.”

The report also found that the NOPD was arresting a disproportionate amount of African-Americans through the practice of racial profiling. The Times Picayune reports that, “in other cities that collect data, the ratio of black-to-white juvenile arrests is 3:1 after adjusting for population,…the rate in New Orleans is 16:1.”

These are just some of the most egregious in a long list of problems including K9 units that attack their own handlers. Hopefully over time, the NOPD will see effective reform, but the problems persist. If you or anyone you know has been mistreated by the NOPD, Bloom Legal can fight for you.
