BloomLegalTV: New Orleans DWI Attorney Says You Can Get a DWI on a Tractor, Jet Ski
Good afternoon and welcome to another one of our video blogs. My name’s Seth Bloom of the law firm of Bloom Legal. We’re here in New Orleans today. I hope everyone had a safe and happy holiday season and New Year’s. Sorry about LSU in the BCS National Championship game. I guess Alabama wanted it a little bit more.
But today I wanted to talk about a topic that we’ve talked about many times, it’s a focus of my practice, and that’s DWI’s – driving while intoxicated. Everyone knows that you can get a DWI while driving an automobile, but I thought it was important to maybe talk for a few minutes about other ways people can get DWI’s, and that they get the DWI’s all over New Orleans and all over the state of Louisiana on a regular basis. Here we’ve represented people who’ve gotten DWI’s on motorbikes, on mopeds, in addition to that also in various watercrafts.
So I thought I’d pull out today the Louisiana Criminal Code here and just read to you the statute a little bit. It’s Statue 1498 and it’s called “Operating a vehicle while intoxicated.” The crime of operating a vehicle while intoxicated is the operation of any motor vehicle, aircraft, watercraft, vessel, or any other means of conveyance when the operator is under the influence of an alcoholic beverage. So therefore, what that means is that you can get anything that is motorized, that you are riding on the road, on public roads, you can get a DWI for.
So again, you want to go back to all the things we said before about DWI’s. If you had anything to drink, you shouldn’t be on the road. You shouldn’t be on the water. The Coast Guard is actively arresting people all over the state, especially as it starts to warm up in the spring and in the summer when people start boating and doing other sorts of water activities. You can get a DWI. Jet ski, you can get a DWI. So please be careful. If you’re going to be drinking, you shouldn’t be operating any motorized vehicle.
And if you ever check my blog, we like to post every once in a while about very interesting DW’s from around the country. And you will see, especially in the rural parts of the country, people will get DWI’s on tractors and on other sorts of construction equipment. So please be careful. Don’t drink and drive.
