Former NOPD Officer Sentenced to Eight Years for Danziger Bridge Incident

Former NOPD Officer Michael Hunter was sentenced to eight years in prison this afternoon for his participation in the shooting and police coverup in the aftermath of Hurricane Katrina that is now being referred to as the Danziger Bridge incident.

Surprisingly enough prosecutors (not Hunter’s defense attorneys) had been seeking to delay Mr. Hunter’s sentencing until after his testimony against other NOPD officers indicted in the matter.

U.S. District Court Judge Sarah Vance denied requests for delay and imposed the maximum allowable sentence under the law. Hunter will, however, be eligible for a sentence reduction if he testifies against other officers later in the proceedings (which he is expected to do).

Michael Hunter pled guilty to obstruction of justice and misprision of a felony earlier this year in April.

“Katrina Defense” to Receive First Test in Court

The trial for the Henry Glover case in which NOPD officers are charged with shooting an unarmed civilian, beating those who attempted to bring him to seek medical attention and the eventual burning of his body and falsification of police documents is scheduled to move forward this month.

The case is notable for its complexity given the number of defendants involved as well as the varying charges against them. It also represents the first test to what is being referred to as the “Katrina Defense” which cites the extreme conditions faced by NOPD officers in the aftermath of the storm as extraordinary circumstances which may have justified actions that would normally be considered illegal activities.

New Orleans Courts Closed on Monday

In honor of All Saints’ Day, New Orleans Courts will remain closed today. This means that anyone arrested over the weekend will have to wait until tomorrow to make any first appearances in court before a judge.

If someone you know was arrested over the weekend for any reason (we know there was a lot of partying to be done at Voodoo, the Saints Game, Halloween, etc), it is important to keep in mind that they will not be able to be released until tomorrow. While this can be a difficult situation for tourists, visitors, and locals alike, Bloom Legal is here to help.

The New Orleans Police Department issued a statement today indicating that they will be conducting a sobriety checkpoint in the Gentilly area from approximately 9pm to 5am on Wednesday, September 22nd.

Drivers are advised to have the proper documentation (proof of insurance, driver’s license, etc) available if requested.

Supreme Court to Hear Case of New Orleans Prosecution Misconduct

The Supreme Court will take on a New Orleans case, Connick vs. Thompson, in October, from a murder trial in 1985.

The Orleans Parish District Attorney’s Office is being held responsible for a suspected failure to train their prosecutors because they did not turn over evidence, which ended up acquitting defendant John Thompson, to the criminal defense team.

Thompson was found guilty of murder and spent multiple years on death row for a crime he did not commit, apparently because of this withheld information from the prosecution. Crime lab documents were discovered in 1999, which proved that the blood types originally withheld as evidence did not match. The Supreme Court case against the Orleans Parish District Attorney’s Office will be heard on October 6th.

This news surfaces during a period when NOPD Superintendent Ronal Serpas and Mayor Mitch Landrieu are instituting measures to correct widespread corruption throughout the department. NOPD Superintedent Serpas Outlines Plan to Restructure the Department

NOPD Superintendent Ronal Serpas outlined a 65-point plan to restructure and reform the practices of his department at a press conference held this morning.

Serpas announced that the NOPD has already undertaken various departmental restructuring initiatives and that it will be instituting new rules and initiatives to take effect in the near future. Among these are rules that would make lying or issuing false statements within the department cause for dismissal.

Falsifying or modifying police reports with the intent to deceive would also be grounds for firing officers.

This announcement comes as part of Mayor Mitch Landrieu’s campaign to reform aspects of local government and law enforcement that have become notorious for corruption and abuse of power. In theory, these new initiatives should help reinforce the rights of arrested citizens to due process and fair trials.

DWI Checkpoint Warehouse District Tonight

NOPD Cleaning Up

Nineteen-year NOPD veteran, Michael Roussel, was arrested Tuesday night by the FBI for suspicion of wire fraud.  Sheila Thorne, who spoke on behalf of the FBI, did not go into any further detail on the arrest.  The FBI was called in by Superintendent Ronal Serpas over a week ago after receiving news that there was such events possibly occurring within the department.  This move shows an effort on the NOPD’s part to clean up its act following the recent revelations of the Danziger Bridge and Glover incidents, which exposed corruption within the police force since Hurricane Katrina.
