Brother and Sister Bust Father for Possession

The 12 year old son and 13 year old daughter of Thomas Morin, 44, were fed up with their father’s use of marijuana and alcohol, so they took it upon themselves to curb his habit.

The children called the local police station in Cottonwood Heights, Utah and reported his drug abuse. When Sgt. Scott Peck arrived at the house he asked the girl to retrieve Morin’s stash from inside the house. “Yeah, I’ll go get it,” she responded as she ran into the house. She returned with a small, approx. 23 gram, bag of marijuana.

Morin has been charged with child endangerment and possession of marijuana. It is doubtful that he will receive a heavy sentence for so small an amount of marijuana, but the court will try to ensure the children are in a safe environment with their father.

Supreme Court Orders California to Release 33,000 Prisoners

On Tuesday the Supreme Court ordered the California State prison system, which has had troubles with overcrowding, to reduce its population by 33,000 inmates. While the ruling only applies to California, Louisiana and other states facing overcrowding may be affected.

California prisons were so overcrowded that it severely hindered their ability to provide prisoners with proper healthcare, resulting in multiple casualties. The court ruled that the conditions faced by inmates were in violation of the Constitution’s eighth amendment banning cruel and unusual punishment. This ruling may encourage similar cases to be brought against the nations other crowded prisons.

New Orleans, which historically has had a large number of prisoners per capita, has already taken action to reduce the number of inmates due to the high costs of maintaining such a large prison population. Marijuana possession, which had previously required an arrest, now allows an officer to assign a court summons instead, and the new construction of a smaller jail should reduce the number of inmates.

Eighteen Attorneys general, including Louisiana’s, filed friend-of-the-court briefs supporting California’s wish to maintain its current prison population. They point to a similar scenario in Philadelphia during the early 90’s that led to a rash of violent crimes. Supporters of the ruling hope that by shifting funding from the prison into community-based centers, criminals that avoid jail time will receive proper treatment.

Man Gets Life in Prison for Marijuana Conviction

Cornell Hood II was arrested for possession of marijuana with intent to distribute, and a St. Tammany Parish judge decided that, in light of Hood’s prior convictions, he deserved life in prison. This was Hood’s fourth conviction, and his first in St. Tammany.

Hood had recently moved from New Orleans East to Slidell where he requested and received a new probation officer. On a routine visit, the officer found marijuana and alerted the authorities. In the parolee’s home, police found two pounds of marijuana in assorted bags and a digital scale, evidence of an intention to distribute.

Previously, Hood had received two convictions in Orleans Parish for distribution of marijuana, and both times he received a suspended five year prison sentence and five years probation. The St. Tammany prosecutor used these previous convictions to portray Hood as a lifetime criminal deserving a more serious sentence. The judge certainly agreed. After three convictions of a drug related crime that carries a sentence of ten or more years, offenders can be subject to life in prison, but it is rarely invoked for marijuana convictions.

Jazz Fest Schedule Announced

Festival season has officially begun and every weekend is filled with good food and good music, and the biggest music fest of them all is fast approaching. Jazz Fest has announced its schedule for 2011.

Now the difficult task of choosing which days to attend and which acts to see begins. Choosing whether to see The Nevilles or The Radiators’ farewell with friends will be a tough one for the fans of local acts, while Arcade Fire, fresh off their Grammy win, and Willie Nelson, fresh off his latest possession charge, will pit the hipsters against the hippies.

The festival continues to mix local acts and national celebrities with Kermit Ruffins on the same stage as Lupe Fiasco. Galactic playing before Wilco is a great example of what Jazz fest has become. The day is filled with great local food and music from great local bands, and the evening focuses more and more on big name acts.

The fairgrounds will be packed on April 29th, opening day, with Robert Plant performing, all the way to May 8th when the Nevilles play the last show.

Willie Nelson Avoids Jail Time for a Song

Willie Nelson was up to his old tricks when a Border Patrol agent smelled pot smoke coming from the country legend’s tour bus in November. He was charged with marijuana possession and ordered to appear in a Texas court.

To hear Willie tell it, the tour bus had just recently picked him up in California, and he had completely forgotten about a small bag of marijuana which had been left on board from his last tour. Of course, if that is true, then the agent never smelled smoke and had no probable cause for a search. Then again, the fact that it was Willie Nelson’s tour bus might have been reason enough for suspicion.

It seems Willie is used to this sort of thing by now and took the proceedings in stride. His attorney jokingly suggested that Willie perform the judge’s favorite song Blue Eyes Crying in the Rain rather than perform jail time or community service. The judge seemed to like the idea and let the county legend off with a guilty plea and a minor fine.

The in-court performance was actually just a joke between the involved parties, but media outlets picked up the story as if it were true with a mixed reaction of anger and humor. The light sentence was a result of a more lenient stance on marijuana possession.

Pot Possession and Prostitution Reclassified as Municipal Offenses

Before Thursday, a person who was found possessing any amount marijuana or involved in prostitution would be immediately arrested because the crimes were only illegal under state law. The New Orleans City Council has voted unanimously to reclassify these and two other minor crimes as municipal offenses, so that an officer has the option of issuing a court summons rather than making an arrest.

This may seem like a reduction in punishment, but Police Superintendant Ronald Serpas claims this change is, “not being soft on crime but smart on crime.” Having been forced to make arrests every time they found the smallest amount of marijuana meant that police officers would be off the street for as long as two hours while they processed the arrestee. The person would then often be released within hours, even if they had not made bail, rendering the officer’s time useless.

The constant arrests also clogged the criminal court system that could be using the time for more serious felony cases. The municipal court is predicted to handle its new case load more quickly than the criminal court has been.

Marijuana-Spiked Brownies Brought into Lafayette High School

Last Friday a student of Lafayette High School complained of a stomach ache after eating a brownie at lunch. The schools resource officer then conducted a field test on the brownies and found that they had been laced with marijuana.

An unknown number of students, including the student that became ill, were given the brownies without knowledge of their ingredients. Two students will face possession charges, and a third will be charged with possession with intent to distribute. The students were all between fifteen and sixteen years old.

Because of their age, the students have been released to their parents, and their names are not being revealed to the public. It is obvious that these young people have made a mistake that will stick with them as they apply to college and begin careers. It is hard for young people to comprehend the full consequences of their actions, and when these actions have long-term detrimental effects on their lives, it is truly a tragedy.

Man Smokes Pot While His Child is Born

A man in western Pennsylvania found the anxiety of childbirth too much to endure unaided. While his child was being born, he decided to bypass the customary cigar and celebrate with a joint.

A nurse of Uniontown Hospital was out on her smoke break when she smelled marijuana. She alerted hospital security who called police at 3:20 a.m. The police arrived to find the man puffing away in the hospital’s designated smoking area. He told police, “I’m having a baby and wanted to get a buzz.” The father then gave police a bag of marijuana that he had been hiding in his shoe.

As forthcoming as he was, the father will still be facing marijuana possession charges. The man was able to be released to a family member, but in New Orleans anyone charged with possession will be taken to jail. Mother Jailed After Toddler Eats Marijuana

Twenty-two year old mother, Nicole Corbet, has been arrested and charged with reckless endangerment of a child and possession of marijuana with intent to distribute.

Corbet and her roommate, twenty-five year old Fernando Booker, had rented a hotel room and decided to bring along both a large stash of cannabis and Corbet’s two year old daughter.

Police later received a distressed 911 call from Corbet franticly confessing that her daughter had eaten an unknown amount of the drug and was possibly in danger. Paramedics have announced that the little girl is in good health and that she may not have felt any of the drug’s typical effects. She is now in protective custody pending the outcome of her mother’s legal problems.
