NOLA’s Times Picayne Sues for Public Access to Crime Records

April 25th, 2008 | Posted in Courts, Local Issues by bloom | No Comments »

Since Katrina, there hasn’t been access to crime information for locals like folk in other parts of the country get all the time.  For example, over in San Antonio, anyone interested in the number of crimes in their neighborhood just surfs over to a website provided by the city or calls the SAPD for details.

Today, the NOLA Times Picayne got sick and tired of the whole mess and filed a lawsuit.  Looks like things will change pretty soon.  There’s a hearing set for May 23rd.

What about Privacy after an arrest?

Meanwhile, what if you are arrested and you’re rather not have your neighbors know about it?  What if your husband or son gets popped for a DUI during JazzFest, this isn’t something that you want everyone to know, right?

Well, relax.  The information doesn’t give out names and other identifying information, just that arrests have been made.  You’re still innocent until proven guilty – even if the gossips never seem to remember that, or think that way.

Product Recalls – Do You Have a Defective Product in Your Home?

March 25th, 2008 | Posted in National Issues, Personal Injury by bloom | No Comments »

clock.jpgUnfortunately, there are so many product recalls that it’s impossible to know whether or not everything you own – the car you drive, the toys the kids play with, the kitchen appliances you use, the food you eat – is safe.

Use common sense, and if you’ve got any concern whatsoever, check out the product over at recalls.gov.  Never use any product that you’re not 100% sure is safe.

You can search for product recalls in:

  • consumer products
  • food, medicine, cosmetics
  • motor vehicles, car seats
  • environmental products
  • meat and poultry products
  • boats and boating safety

Really interested in recalls?  Sign up for emails notifying you of future recalls from the Consumer Products Safety Commission, the Food & Drug Administration, and the U.S. Department of Agriculture.

Remember, time is not on your side in a defective products claim ….

If you or a loved one has been harmed by a defective product — do not wait to get legal advice.  The law has specific deadlines, and if you miss the deadline even the worthiest claim will be time-barred

Don’t procrastinate!

Kanye West’s Mom and Dennis Quaid’s Twins: How to Prepare 4 a Medical Malpractice Suit

November 21st, 2007 | Posted in Celebrity Justice, National Issues by bloom | No Comments »

janadamsdco.jpgToday’s news is filled with the scoop that Dr. Jan Adams, the plastic surgeon that operated on Kanye West’s mom right before she died, walked off the live set of Larry King Live last night.  TMZ has the video, if you want to see the replay.

And, right along with that reporting is the story that Dennis Quaid’s infant twins were inadvertently overdosed while at Cedars Sinai and while the situation was scarey, it looks like they’re going to make it.

Okay.  What should these families be doing, to protect their interests in they want to file a medical malpractice suit later?  What should you do, if you’re in a similar situation?

The Death of Kanye West’s Mother – Medical Malpractice

November 14th, 2007 | Posted in Celebrity Justice, National Issues by bloom | No Comments »

west.jpgOver the past few days, not only has the untimely death of Kanye West’s mother been reported, but TMZ.COM has gone to great lengths to investigate the criminal and civil history of her plastic surgeon, Dr. Adams (BloomLegal has compiled this into a shockingly long list, shown below).

Condolences to the West Family, and good luck to them in their medical malpractice claim against Dr. West — which you know is coming.  And to think this guy appeared as a plastic surgery expert on Discovery Channel and on Oprah (check out his website).

How can you protect yourself in these situations?  How do you know that you can trust your doctor? Continue Reading »

California Fires — Malibu to San Diego: 5 Things U & the Celebrities Can Do When Your Home is Threatened

October 22nd, 2007 | Posted in Celebrity Justice, National Issues by bloom | No Comments »

fire_01.jpgThe California fires continue to rage this morning, covering an area north of Malibu southward to San Diego.  Right now, there are 11 major wildfires that have already decimated over 30,000 acres of land.  And more wildfires are expected: burning embers will be carried by the Santa Ana winds throughout more of dry Southern Californian land today.

It’s rumored that the fires began after high winds blew down some power lines, which landed in dry brush with their small electrical sparks starting all this.  The San Diego fires have already claimed one life this morning.  A map of the California fires can be found at the National Weather Service California Fire Site.

What celebrities are at risk here?  Who’s been evacuated?  What should they — and you — do if faced when fire (or other natural disaster) threatens your home? What’s the law here? Continue Reading »

Howard K. Stern Sues Over the Cosby Book – Where’s Larry Birkhead? What about DannieLynn?

October 2nd, 2007 | Posted in Celebrity Justice by bloom | No Comments »

blondeambition3.jpgHoward K. Stern filed a $60 million suit against (1) Rita Cosby and (2) Hachette Book Group USA, Inc. today in an Atlanta federal court.  He’s asking for $10 million in actual damages and another $50 in punitive (or punishment) damages from the author and publisher of Blonde Ambition

Larry Burkhead isn’t a party to this suit; however, his lawyer is claiming that Larry will be filing suit against Cosby and her publisher, too.

In his lawsuit, Howard K. Stern claims he has been harmed by the book, and that Anna Nicole Smith has been harmed, too, because the “[d]efendants have exploited Ms. Smith’s life and death by publishing false and defamatory factual accusations” against Stern.  Which implies that Dannielynn has been harmed, as well, even though she’s not a party nor is Anna Nicole’s estate at this point.

How is Dannielynn harmed?  Think of Lisa Marie and Elvis — Elvis’ legendary persona benefits Lisa Marie in many ways; if nasty things were imputed to Elvis now, Lisa Marie would be hurt financially and otherwise.  Same for Dannielynn — she stands to benefit from the continuing popularity of Anna Nicole and to the extent that Anna Nicole’s persona is harmed, DannieLynn is harmed as well.

Of course, how AnnaNicole’s reputation could be tarnished and harmed at this point — well, there’s a fact question for the jury if there ever was one ….

Larry Birkhead, Howard K. Stern & Debra Opri: Will Opri’s Lawsuit Reveal the Video?

September 26th, 2007 | Posted in Celebrity Justice by bloom | No Comments »

blondeambition32.jpgLarry Burkhead has been counter-sued this week by his former attorney, Debra Opri.  Debra Opri is claiming that Larry Birkhead harmed her reputation when he appeared on Larry King Live and said that Opri was a source for Rita Cosby, as she was writing her book, Blonde Ambition.  Opri’s alleging that she’s had to spend $200,000 on a “crisis management team” to “salvage” her reputation.  TMZ has put the Opri counterclaim online, if you want to read it.

What’s going on here? Can lawyers sue clients? Why would Opri sue Burkhead? And, will this force the revelation of the source materials for the Rita Cosby book?  Will we get to see the video here? Continue Reading »

Britney Spears’ Custody Fight: Today’s Secret Witness

September 17th, 2007 | Posted in Celebrity Justice by bloom | No Comments »

britneymtv1.jpgGloria Allred represents a “secret witness” who filed a declaration in Britney Spears’ custody fight with Kevin Federline, a man who she reportedly described to FoxNews as, “[y]ou may recognize him as we walk into court, but maybe not.  He is not famous.  He’s just someone who’s concerned about the kids.”  Needless to say, the declaration helps K-Fed and hurts Britney.

What is all this about a secret witness?  Isn’t this America?  How can someone just write something down, and use it against Britney?  Isn’t that unfair?  What about due process? Continue Reading »

Larry Birkhead, Howard K. Stern & Rita Cosby – Will Larry Sue Part II

September 10th, 2007 | Posted in Celebrity Justice by bloom | No Comments »

blondeambition31.jpgWill Larry Birkhead Sue?  Larry Burkhead says he will, so does Howard K. Stern.  Nothing’s been filed yet.  Before pondering why not, let’s review what’s happened since our last post:

1.  DannieLynn turned one last week, and there was a big party for her in Kentucky: both Larry Burkhead and Howard K. Stern were there.

2.  Rita Cosby’s book Blonde Ambition did hit the shelves, and was No. 56 at amazon.com at the time of this post.

Of course, the price has been slashed in half, and it’s getting very bad reviews.  Readers are pointing out that the book has no index, no footnotes, no documentary support; one comparison to the heavily-documented John Belushi bio Wired has been made.   (Of course, Bob Woodward of Watergate fame wrote that one.)

And, in a truth is stranger than fiction report: this morning, amazon.com is offering a twofer deal: get Rita Cosby’s book AND O.J.Simpson’s If I Did It, where proceeds go to the Goldman Family, for $29.36.  That tells you something.

3.  Larry Birkhead just won a big round in his suit with Debra Opri: she doesn’t get a quiet arbitration, they’re headed for trial. The arbitration clause didn’t hold.

4.  Some crazy guy just sued Howard K. Stern for $100 million.  Who?  The brother of Cosby’s source for the Stern-Burkhead gay lover story, Jackie Hatten.  Why is he in jail?  He serving 6+ years prison time for making criminal threats against Anna Nicole and actually attacking her neighbor.

Okay, so … will Larry sue? What about Howard?  Continue Reading »
