Hardy Boyz: Facing Multiple Legal Troubles

Matt Moore Hardy, 36, is facing legal troubles with driving while impaired. The police report claims Hardy was under the influence of drugs, not alcohol; the breathalyzer test was negative.

Hardy was on probation with his Wrestling company when State troopers charged him on Aug. 20 with driving while impaired after he crashed his 2009 Chevrolet Corvette into a tree. This arrest caused TNA Wrestling to fire Hardy.

Meanwhile, last week Jeff Hardy pleaded guilty to three felony drug charges and was sentenced to serve 10 days in jail and pay a $100,000 fine, followed by 30 months on probation.

DWI Checkpoint Tonight in the Treme Area!

NOPD has issued a statement today indicating that it will be conducting a sobriety checkpoint TONIGHT (FRIDAY 9/9) in the Treme area from approximately 9pm to 5am. No specific indication as to the location of the checkpoint will be released.

Drivers are advised to have the proper documentation (proof of insurance, registration, driver’s license, etc) available if requested.

Man Receives 99 Years for DWI

After multiple offenses a DWI charge can change from a blemish on your record into a life altering felony DWI conviction. Arthur Ortega of Austin Texas learned this when his 7th DWI charge resulted in a 99 year jail sentence.

Last October Ortega got behind the wheel of his car after a night of drinking and nearly took a man’s life. He almost hit the Austin area police officer that made the arrest. The officer, after finding that Ortega has received 6 previous DWI convictions, charged him with felony DWI. At the time of the arrest, Ortega was also on parole for a 30 year burglary sentence.

After a two day trial the jury decided Ortega had used his vehicle as a deadly weapon, which contributed to the especially harsh sentence. The deadly weapon finding also means that Ortega will not be eligible for parole until he has served the first 30 years of his sentence.

Man Assaults Himself to Avoid DUI

There have been many strange attempts to avoid a DUI charge including the myth that putting pennies in your mouth tricks a breathalyser and one man who ate his own underwear to soak up the alcohol in his stomach. In that long tradition of half-baked plans, Daniel Vagnini attempted to convince police that he had been assaulted as an explanation for his poor driving.

Police spotted the 22 year old Conneticut native running a stop sign and nearly crashing into another vehicle. The officers tried to follow Vagnini and eventually found him lying next to his car in some nearby woods with tattered clothes, missing his wallet and keys, and showing other signs of an altercation.

Vagnini had struck himself in the face repeatedly, torn his shirt, and thrown his wallet and keys in a nearby river. He tried to explain to officers that while drinking in nearby Hartford he had been assaulted and blacked out. The officers did not take long to see the many holes in the story, including how that would explain the absence of his keys, and arrested Vagnini for reckless driving, driving under the influence, and evading responsibility.

825 Alcohol Citations Issued Over Mardi Gras

The office of Alcohol and Tobacco Control was very busy over Mardi Gras cracking down on under age drinking and the sale of alcohol to minors. Throughout the entire state, officials gave over 825 citations, 666 of which were given in the New Orleans area. Luckily, the only arrests were of five people who attempted to flee.

Of those citations, the majority of citations given locally were for underage drinking and selling too minors, the French Quarter saw 393. Citations along parade routes were fewer. The busiest day only saw 53 citations for parade goers, and only 30 were given on Mardi Gras day. Possibly the biggest bust of the season was of a keg party held by a fraternity in the back of a moving truck.

The fraternity had parked a moving van filled with kegs on the corner of Carondelet and St. Joseph and for $20 allowed people to drink all day. Officials charged them with selling alcohol without a license and selling alcohol to minors after they found the fraternities wristbands on minors. One of the three people that took responsibility for the event was only twenty years old. The agents seizes 97 kegs and shells with approximately 1,503 gallons of beer inside. This number does not include the 100 kegs that the group had bought earlier in the week.

DWI Checkpoints Get a $350,000 Improvement

Orleans and Jefferson Parish are both planning to purchase special vans to be used in future DWI checkpoints. Each van comes with a $350,000 price tag and a number of features to aid officers.

The Breath Alcohol Testing vans (or BAT vans) will have breath-testing machines to help identify inebriated drivers, an interview room, and a holding cell that can accommodate multiple offenders. There will also be a bathroom for the officers’ and arrestees’ convenience. In order to expedite the legal process, a separate room in the vans will allow officers space to begin paperwork on arrests. Many cities across the country have already begun using the BAT vans, including Baton Rouge and Mobile.

Shocker…Paris Hilton Charged with Felony Drug Possession

Up to her old tricks, Paris Hilton has been charged with felony possession of a controlled substance – cocaine.

Hilton was stopped in Las Vegas by police who allegedly smelled the strong odor of marijuana emanating from a vehicle driven by Hilton’s boyfriend, Cy Waits, who has been arrested for DWI.

According to reports, after requesting access to her purse for lip balm, Hilton opened the purse at which point officers witnessed a small bindle of what appeared to be cocaine fall from the purse and into their hands.

Hilton is currently charged with possession of .8 grams of cocaine, an amount indicating felony status with sentences in Nevada ranging from probation to 4 years in prison. It is unclear at this point what the outcome will be while Hilton and her family adamantly deny her ownership of the cocaine (and, on occasion, the purse).

Kenner City Council Committee to Meet About Regulations for Alcoholic Beverage Outlets

A committee created by the Kenner City Council last week, after a proposal to require bars to close between 2 am and 6 am was voted down, will be meeting for the first time this Monday.

The committee will be discussing instances of crime near alcoholic beverage outlets in the early mornings. While it is unclear exactly what will be on the docket, there remains a possibility that the City Council may soon issue new policies limiting the hours during which alcohol can be made available for sale.

The committee’s primary concern appears to be reducing instances of drunk driving and reckless operation. DWI Checkpoint Algiers Area Tonight
