Metairie title agent imprisoned for $777,000 wire fraud

Hubert Ellzey Jr. secretly bilked clients out of $777,000 before Hurricane Katrina put an end to his scheme.

When the storm hit Aug. 29, 2005, all real estate closings in the New Orleans area halted for a time, upsetting the Metairie title agent’s practice of converting clients’ mortgage money to his personal use then covering the misappropriation with money from future mortgage payments.

As a result, he pleaded guilty Sept. 23 to wire fraud, and U.S. District Judge Eldon Fallon sentenced him Thursday to almost three years in prison.

Ellzey, 68, worked nine years as an independent agent for Commonwealth Land Title Insurance Co. His job called for using his escrow account and wire transfers to move money among financial institutions as they granted and paid off loans.

But sometime before June 2005, he started diverting money into his own accounts then covering his tracks with money from later mortgage payments, according to court records. That happened on six real estate closings in Avondale, Gretna, New Orleans and Metairie, involving lenders in Georgia, Illinois, New York and Texas.

“The scheme was discovered when, after Hurricane Katrina hit New Orleans … all closings came to a halt and Ellzey was unable to cover some of the funds converted to his own use and to close the pending mortgages,” said a statement from the U.S. attorney’s office.

The case was investigated by the FBI and prosecuted by Assistant U.S. Attorney Juan Masini.

Fallon, whom President Clinton nominated for the judgeship, sentenced Ellzey to 35 months in prison, followed by three years’ probation. He also ordered restitution to Commonwealth.

paris-hilton-celibate.jpgBarron Hilton, Paris Hilton’s kid brother, got busted for Driving Under the Influence (DUI) early yesterday morning – the time of his Malibu arrest was 8:05 a.m.  Seems Barron took a breathilizer (did he check with his lawyer first? I doubt it) and blew a .14 (.08 is the legal limit)In the car with him, an unidentified girl and a fake ID.   Sounds like Barron had a wild night, right?

car_crash_2.jpgThis afternoon, Kiefer Sutherland’s attorney announced that he pleads “no contest” to Driving Under the Influence (he was arrested on 9/25 for two misdemeanor counts of DUI)  — he pled the same thing to a prior DUI in 2004. 

Also this afternoon, Britney Spear’s attorney appeared in court on her behalf — and Britney has been ordered to come into LA County and be booked for hit and run before the big 10/26 hearing in her custody case.

OJ Simpson – No Slam Dunk Here

oj.jpgThe Guardian has compiled a good overview of what happened in Vegas with OJ Simpson in the hotel room with all the sports memorabilia.  The Associated Press has prepared a timeline, as well. 

TMZ is quoting a story from the New York Post, where six weeks ago OJ allegedly appeared at the home of his handyman, girlfriend Christine Prody in tow, to accuse the guy of sleeping with Prody and threatening to kill him.  Included in the story is a reference to several domestic dispute calls made by Prody over the past 10 years. 

Meanwhile, OJ’s being used as the prime example of a “well implemented asset protection strategy” by at least one law firm, while the Goldman Family is attempting to seize the Vegas sports memorabilia as part of collecting on its civil judgment and they’re investigating the possibility of money stashed in offshore bank accounts.  They’ve already obtained OJ’s Rolex, after seeing the watch in a news photo covering the Vegas caper. 

OJ made bail, even though several pundits were arguing that it would never happen.  He left Nevada, and returned to Florida without a problem.  He’s said to be pleading “not guilty” to the charges.

Hulk Hogan’s Son in Car Crash — Hulk At the Scene: 10 Things to Do When You Witness a Car Crash

hulk_hogan.jpgHulk Hogan’s son was seriously injured last night, when the Toyota Supra he was driving went out of control, jumped a median, and crashed into a tree.  Nick Hogan was driving.  Both he and his buddy, John Graziano, were airlifted to a nearby hospital and reported to be in serious condition.   This morning, Hogan’s pal John remains in critical condition, but Hogan’s injuries are no longer listed as life-threatening.  (TMZ is reporting that Hulk Hogan’s son has been released.)

Hulk Hogan was filmed at the scene of the accident, moments after it occurred.  News reports are unclear, but apparently paramedics arrived quickly, and The Hulk was seen talking with them, as they awaited the MediVac helicopter. 

What should you do if you are ever in the position that Hulk Hogan was in, at the scene of a car crash, where there are victims who are seriously injured?

Michael Vick Accused of Executing Dogs: Should He Take the Plea Deal?

Atlanta Falcons Quarterback Michael Vick’s pals ratted him out this mornvickpb_crop.jpging.  (Read their 12-page written statement here.) His two dogfighting business partners accepted a plea bargain, and as part of their deal, offered up evidence that Vick executed dogs who failed to pass preliminary test fight standards by electrocuting, hanging, or drowning them.  With this deal, Vick is left standing as the sole defendant in the federal criminal case.

Vick’s got a deadline today to take a deal, too – with a recommendation of one year in jail – or go forward, alone, to stand trial on all these charges.  Specifically, Michael Vick has been already charged with conspiracy to travel in interstate commerce in aid of unlawful activities and conspiring to sponsor a dog in an animal fighting venture.  These charges have mandatory punishments under the sentencing guidelines established under federal law, and carry a maximum prison term of five years and a $250,000 fine.   Executing the dogs?  More charges can be added.

Lindsay Lohan Is Going to Jail says NOLA Attorney

lohan_arrest2_070724_ms.jpgLindsay Lohan is stupid or crazy and she’s going to jail.  Think about it:  four days after turning herself into authorities for her Memorial Day crash, and getting officially charged with DUI, she’s busted again for (1) suspicion of driving under the influence; (2) driving while her license is suspended; (3) possession of a controlled substance (cocaine); and (4) bringing contraband into a custody facility.   You know the story

Then, LiLo gets released on bail, gets thrown into another rehab facility (you can bet that her attorney insisted upon this), and e-mails Billy Bush of Access Hollywood to report that she’s “innocent” and wants everyone to “respect her privacy.” Innocent? Right.

Meanwhile, her dad is busy making money doing TV interviews and her mom is not rushing to help – compare this to Kathy Hilton – and her pals are telling the media that they are afraid Lindsay Lohan may harm herself.

Nicole Ritchie – Let’s Talk Plea Bargaining

nicole-ritchie-hairstyle.jpgTMZ.COM is reporting that Nicole Ritchie is on her way to Canada with fiance Joel Madden (who has a gig in Calgary with his band Good Charlotte) although her DUI trial was set to start this morning.  How can she just leave the country on trial day?  Didn’t Paris Hilton get in trouble for just being a few minutes late to her hearing? 

Well, the story is that the DA offered up a plea bargain, and Nicole’s lawyers are working  on her behalf, finalizing the deal.  Maybe the reported documentation that Nicole Ritchie had at the ready, on the unreliability of the drug testing performed on her, was a deal maker? 

You’ve seen plea bargains on TV; Law & Order has them all the time.   So, if you’re in the hoosegow and the word “plea” comes up, what should you do?  What is plea bargaining, exactly?

Paris Hilton – What Happens When U (& Paris) Go To Jail

parishilton.jpgLast night, Paris Hilton evaded the media hoard surrounding the Lynwood County jail in LA by surrendering to authorities at a downtown LA all-male facility.  Paris was then transported to the Lynwood facility. 

Starting today, she’s serving half of her sentence, or approximately 3 weeks, in a 12 foot by 8 foot cell that contains two bunks as well as a toilet.  So far, she doesn’t have a roomie.

Just so you know, Paris has not had any special treatment thus far — assuming media reports are accurate.

MySpace: Celebrity Lists, No; Sex Offenders, Yes

Odds are, you or someone you know has a MySpace page.   Every 2008 Presidential Candidate doesParis Hilton does.  Heck, even Kevin Federline does. 

MySpace doesn’t provide a list of celebrity pages, confirmed to be authentic.  Some bloggers are doing that: check out RandomCrapOnline.Com (gotta love that name) and Bumpshack.Com.   (The New York Times is keeping track of the presidential candidates.) 

However, MySpace has compiled a list of over 7000 registered sex offenders with pages on its site, and removed all their MySpace pages.  Beginning this week, MySpace is releasing this information to the different states, giving state authorities a list of offenders for their area who were using the MySpace “social networking” site.   On Tuesday, for example, Illinois Attorney General Lisa Madigan received a list of 584 names from MySpace.
