DWI Checkpoint Tonight – Uptown Central City!

NOPD has issued a statement today indicating that it will be conducting a sobriety checkpoint tonight (Friday 1/28) in the Uptown Central City area from approximately 9pm to 5am. No specific indication as to the location of the checkpoint will be released.

Drivers are advised to have the proper documentation (proof of insurance, registration, driver’s license, etc) available if requested.

DWI Checkpoints Get a $350,000 Improvement

Orleans and Jefferson Parish are both planning to purchase special vans to be used in future DWI checkpoints. Each van comes with a $350,000 price tag and a number of features to aid officers.

The Breath Alcohol Testing vans (or BAT vans) will have breath-testing machines to help identify inebriated drivers, an interview room, and a holding cell that can accommodate multiple offenders. There will also be a bathroom for the officers’ and arrestees’ convenience. In order to expedite the legal process, a separate room in the vans will allow officers space to begin paperwork on arrests. Many cities across the country have already begun using the BAT vans, including Baton Rouge and Mobile.

The sheriff’s office is spending a lot of money to take drunk drivers off of the road, and the best way to avoid legal trouble is to use a designated driver or a taxi; however, we understand that mistakes can be made under the influence of alcohol. Thanksgiving Tops Stats for Travel and DWI

Many people know that Thanksgiving is the biggest period of travel across the United States due to the extremely large number of individuals making their way to spend the holiday with friends and family.

However, some people are not aware that according to many reports it is Thanksgiving (not New Year’s Eve as is often assumed) that represents the biggest spike in the rate of DWI and alcohol-related arrests, accidents, and fatalities.

Thanksgiving is a time for family and togetherness and with family gatherings often come celebratory activities and a higher rate of alcohol consumption. This leads to a higher instance of impaired drivers on the road and can unfortunately turn the festive Holiday into a time of tragedy for many families.

Many states and cities have begun strict enforcement policies against impaired driving due to the historically high number of alcohol-related incidents during Thanksgiving. Some states are even resorting to “no-refusal” sobriety checkpoints in which drivers have no choice but to submit to breathalyzer or blood tests. This means that even drivers who are not excessively impaired face the risk of being arrested.

It is important to remember over the Thanksgiving Holiday to be extremely careful and to always use a designated driver or cab service when traveling from location to location. Supreme Court Extends Stay, Agrees to Hear Appeal in Favor of Banning Traffic Cameras

The Louisiana Supreme Court has extended the 4th Circuit Court of Appeals’ stay against Judge Paulette Irons’ ruling that traffic cameras violate the New Orleans City Charter.

Following Judge Irons’ ruling against the cameras, the city immediately issued a request for a stay of the ruling which was upheld due to the large amount of revenue the city was expecting to generate from the cameras in order to support its current budget projections. That original stay expired today but has been extended by the Supreme Court pending the appeals process.

It is unclear how the case against traffic cameras will unfold in the Supreme Court but we will continue to monitor its progress and post the latest information here.

State Police Stage Mock Accident to Prove Dangers of Texting While Driving

This week, state police set up a mock accident in which one teen driver was texting while driving and ran into another.

In order to give a strong message to the people of Louisiana about the new law prohibiting texting while driving, firefighters cut out the young girl who received the brunt of the accident from the car of the texting teen and told her mother that she was no longer going to be able to perform simple tasks such as eating or brushing her teeth.

Officers took the other girl away in cuffs charging her with the negligent act of texting and driving. These officers were making it clear to those who viewed the mock accident in person, or on the news, that Louisiana is serious about its new law prohibiting texting and driving.

Court of Appeals Issues Stay Against Judge’s Ruling on Camera Tickets

The 4th Circuit Court of Appeals has issued an emergency stay at the request of the City of New Orleans against Judge Paulette Irons’ ruling last week that traffic cameras violate the city’s charter.

The city’s attorney is expected to request a permanent stay today. Traffic cameras were expected to generate an additional $15 million in revenue this year so the potential suspension or elimination of the Photo Safety Program is being met with considerable resistance.

These developments reverse the information that was released on Friday indicating that traffic tickets issued over the weekend would be considered null and void.

New Orleans Judge Rules That Traffic Cameras Violate City Charter

Judge Paulette Irons ruled today that the city’s recently installed Photo Safety Enforcement Program violates the New Orleans city charter due to the fact that it places its administration under the Department of Public Works rather than the Police Department.

Judge Irons indicated that tickets issued after her ruling (today) would be null and void.

It remains unclear at this point whether this spells the end of the program altogether or if it will be assigned to the Police Department.

—-UPDATE!!——A Court of Appeals issued an emergency stay against Judge Irons’ ruling which makes tickets issued after 10/1/10 STILL VALID. It is unclear at this point what the ultimate result of this ruling will be. Check back here for information as this story develops.
