Virginia Now Requires Ignition Locks for 1st-Time DUI Offenders

Opponents of drunken driving are applauding the Virginia state Senate for passing a bill to require even first-time DUI offenders in Virginia to install a device to prevent them from operating their vehicle while intoxicated. Currently, the devices are required only after a second or subsequent DUI conviction.

An ignition interlock requires a motorist to blow into a Breathalyzer before starting the car and at random intervals while driving. The car won’t start if the driver’s blood alcohol content is above .02 percent.

According to the National Highway Traffic Safety Administration, nearly 30,000 DUI offenders were convicted in Virginia in 2010. That’s more than three convictions every hour. Kurt Erickson, president of the Washington Regional Alcoholic Program, which campaigns against drunken driving, said ignition interlocks are effective in stopping people from driving while under the influence of alcohol.

“If, before attempting to start their vehicle, the device senses a set amount of alcohol, the vehicle will not start,” Erickson said. “If a running retest senses a set amount of alcohol, the vehicle’s horn will sound, along with its headlights flashing, in order to draw the attention of law enforcement.”

Metairie Woman Killed in Gruesome DWI Crash

A car crash on I-10 Saturday night has resulted in the death of a 76-year-old woman from Metairie, Claire Lajaunie, as well as the critical injury of the driver, a 77-year-old woman from New Orleans.

The intoxicated driver was 22-year-old Dalton Lewis from Pearl River. He was driving his Lexus at over 100 miles per hour when he struck Lajaunie’s Honda SUV from behind, which proceeded to lose control and flip on the interstate after it struck the metal guard rail.

Lewis was treated for injuries before being released into police custody. He is being charged with vehicular homicide and vehicular negligent injury.

Police Vigilant for DWIs as Mardi Gras Approaches

To most New Orleanians, Mardi Gras season means spending time with family and friends, watching parades, and perhaps drinking a little bit more than usual. To Louisiana law enforcement, it means one of the deadliest times of the year for drunk driving accidents.

The Louisiana Highway Safety Commission has provided grants to roughly 45 police and sheriff’s departments across the state to increase enforcement of DWIs throughout the holiday. The money will go towards funding overtime for officers so they can patrol at night to look for intoxicated drivers, as well as conduct more DWI checkpoints.

In 2010, there were six alcohol-related deaths over Mardi Gras weekend, from Friday night through Tuesday. That was more than any other weekend all year. “When you make a poor decision, not only does it affect you, but it has catastrophic consequences for others,” said University of Lousiana-Lafayette Police Chief Joey Sturm.

DWI Checkpoint Friday Night 1/26 – Faubourg Marigny!

NOPD has issued a statement today indicating that it will be conducting a sobriety checkpoint FRIDAY NIGHT (1/26) in the Faubourg Marigny area from approximately 10pm to 5am. No specific indication as to the location of the checkpoint will be released.

Drivers are advised to have the proper documentation (proof of insurance, registration, driver’s license, etc) available if requested.

New Orleans’ Officials Gearing Up for Historical Weekend

New Orleans’ mayor Mitch Landrieu says his office is teaming up with state and federal officials to make this weekend’s events go as smoothly and as safely as possible. On Saturday, the city will host the first round of NFL Wildcard Playoff games, with the Saints hosting the Detroit Lions, followed by the BCS National Championship game – LSU vs. Alabama – on Monday.

“It’s really important that this event be successful, that it be safe and that it works very, very well. We expect almost 250,000 visitors to be with us between now and Monday … All of these events, in total, are going to approximate a 500-million dollar economic impact, which is in excess of what the economic impact is from a Super Bowl,” said Landrieu.

The mayor said 740 police officers will be deployed around the Superdome, in the French Quarter and downtown areas to keep everyone safe. State troopers will augment the force, particularly along major thoroughfares leading into the city.

Judge Charged with DUI

Randal Todd, a western Pennsylvania judge was charged with driving under the influence of drugs or alcohol after Mt. Lebanon police said he caused a minor accident Dec. 16.

Police said the 56-year-old Allegheny County judge was confused and smelled of alcohol when he was stopped at 8:51 p.m. on Shady Drive West.

The criminal complaint says Todd responded that he was “just a little drunk” when Officer Matthew Mankamyer asked if he’d been drinking. Investigators said Todd then failed two field sobriety tests.

Administrative Common Pleas Judge Jeffery Manning said Todd was temporarily assigned to civil cases until his criminal case is resolved.

Defense attorney Bob Del Greco called the arrest “embarrassing” and said Todd could be a candidate for a first-time offender program.

Top 20 Cities for DUI Citations

Trade website, Insurance.com recently released a list of the top 20 cities for DUI citations in the country. Surprisingly to some, New Orleans has not made the list and 3 of the top 5 cities are in California:

4. Jacksonville
5. San Francisco

Data was compiled by comparing the number of individuals requesting car insurance quotes who listed at least one DUI citation on their records with each city’s population information.

Although some of the cities are not necessarily the types of party towns that one would ordinarily expect to top such a list, there are many reasons that these cities may lead the ranks for DUI citations. Primary factors include the cities’ public transportation infrastructure, severity of local DUI/DWI laws, law enforcement resources and a number of other metrics.

New Texas DUI Law Spreads to Louisiana

Texans arrested for drunk driving should prepare to roll up their sleeves for a blood test this holiday season. Cities and counties across the state are increasingly demanding that drunken driving suspects who refuse to take breathalyzer tests submit to blood tests that measure the amount of alcohol in their systems.

The blood test policy has grown from a procedure used in a few Texas towns to one that is used by police state-wide – especially during weekends and holidays when drunken driving is most common. The “No Refusal” initiative, as it is known, has also caught on in other states, including Florida, Missouri, Illinois – and, you guessed it – Louisiana.

The attraction for law enforcement and prosecutors is that blood evidence is a powerful tool in front of juries. Armed with blood evidence of intoxication, some prosecutors say they can win convictions in more than 90% of DUI cases.

Texas courts have uniformly held up the constitutionality of mandatory blood testing; however some argue it is an unreasonable search and seizure.

Often, lawyers say, defendants faced with blood evidence admit their guilt and do not bother with a trial.
