St. Tammany Parish Jail Comes Under Fire from ACLU

The St. Tammany Parish Jail has come under serious fire from the ACLU as a result of an assessment conducted by a prison facility consultant who was hired after a number of inmates managed to escape from the facility.

The controversial issue that is receiving attention is the jail’s use of what have been referred to as ‘squirrel cages’ to house mentally ill inmates and those who have been placed on suicide watch.

The structures are reported to have dimensions of 3′x3′ with 8′ ceilings: the equivalent of 72 square feet. This figure is egregiously small when compared to the minimum 144 square feet recommended to house dogs of over 66 pounds. Inmates reportedly have no room in which to lie down and are forced to sleep curled into fetal positions.

New Orleans Selected as Location for Upcoming Oil Spill Litigation!

The Judicial Panel on Multidistrict Litigation has reached a consensus that the slew of upcoming Oil Spill Litigation Cases will be tried in federal court in New Orleans before Judge Carl J. Barbier.

Obama Supports Plan to Pay Out 80% of BP Penalties to the Gulf Coast

President Obama’s top advisor on energy and climate change issued a statement today that indicated that he would be supporting an initiative proposed by Louisiana Senator, Mary Landrieu that would result in the allocation of 80% of federal penalties imposed upon BP to the Gulf Coast region.

With penalties expected to total at least $5 billion, Louisiana could stand to receive as much as $2.5 billion dollars to support coastal restoration. This is certainly good news for all of those whose lives and livelihoods have been dramatically affected by the Oil Spill and its long term ramifications.

Implications of Social Media on Court Cases and Trials

A recent article about a talk given by Virginia lawyer, Courtney Van Winkle, raised some interesting issues about how social media have come and will continue to influence matters in court and during trials.

In the realm of personal injury cases in particular, information relating to the event in question can often be traced through a defendant’s Facebook profile. In some instances, references to drinking or attending a party on the date of a traffic accident have been used as evidence to suggest that a party was negligent.

This poses an interesting question into how lawyers will come to advise their clients in the future when accepting cases. It may eventually become standard practice for attorneys to require their clients to delete their social media profiles before accepting their cases or at the very least to enable strict privacy settings.

As a general rule, individuals involved in pending trials and court cases should never disclose information that pertains to those trials and the events in question in any sort of public forum. The personal tone and apparent privacy of social media platforms like Facebook can make it easy to forget just how publicly accessible the content within can be.

‘Static Kill’ Procedure Appears To Be Working To Seal Well

BP announced today that the procedure involving pumping heavy mud into its damaged oil well known as a ‘static kill’ appears to have been successful and that the company will be able to begin the process of permanently sealing the well with concrete in the coming days.

Following this, the company will begin work drilling two relief wells that, if successful, should manage to eliminate any threat of future leaks from the well in question.

The successful effort to bring the stricken well under control is certainly welcome news to residents of the affected area which, along with news that approximately three-quarters of the oil spilled into the Gulf of Mexico has either been eliminated or diluted to a point of non-threat, are both indications that original predictions of the severity of the spill may have been overestimations.

The remaining oil in the Gulf (approximately 26% of the total spilled, or 53 million gallons) does, however, represent an amount nearly 5 times that of the Exxon Valdez spill in 1989 and the long-term ramifications of the presence of the oil are likely not yet fully understood. Additionally, the impact of the interruption of operations of many local businesses will certainly be leaving many residents struggling to recover for months if not years.

Orleans Parish Sheriff’s Office Expands Program That Helps To Avoid Jail Time

The Orleans Parish Sheriff’s Office has been running a program since October 2009 that allows individuals convicted of non-violent crimes to avoid incarceration. The New Orleans Day Reporting Center involves 2 levels of primary participation that include daily treatment, drug and alcohol testing, community service, and requirements of maintaining an active job search or enrolling in school.

The initial success of the program which has just seen its 4th group of participants graduate has led to the expansion of the program’s services to include Jefferson Parish this month.

Candidates for the New Orleans Day Reporting Center receive recommendations from the Department of Public Safety’s Division of Probation and Parole.
